Terms & Conditions DISTANCE SALES AGREEMENT

ARTICLE 1 – SUBJECT:

The subject of this contract covers the rights and obligations of the parties in relation to the sale and performance of the service sold by the SELLER to the BUYER, whose qualifications and sales price are specified below.

  ARTICLE 3 – BUYER:

3.1. CONSUMERThe customer who books the room.

  ARTICLE 4 - CONTRACTUAL SERVICE INFORMATION:

The type of service, the sale price, and the form of payment to be determined by the hotel are realized.

  ARTICLE 5 – GENERAL PROVISIONS:

5.1. The BUYER accepts and declares that he/she has read and learned all the preliminary information regarding the qualifications, sales price, payment method and performance of the contractual service specified in Article 4 and gives the necessary confirmation in an electronic environment.

5.2. The BUYER accepts that both he/she has read the Hotel Information, which includes the qualifications of the service she has purchased and has knowledge.  

5.3. He/she agrees that if he/she terminates the use of the service on the grounds that the service rendered is defective, he/she will notify the SELLER's office in writing of the reasons for the termination due to the obligation of cooperation and diligence, otherwise he/she will be deemed to have received and used the service.

5.4. If the contractual service is used by a person other than the BUYER, the SELLER is not responsible for the person's refusal to perform.

5.5. The BUYER is obliged to comply with the laws and customs of the facility in which he/she will stay; he/she will comply with the rules declared by the hotel authorities regarding the service purchased; he/she will not endanger the life and property safety/integrity of third parties, and he/she will be personally and primarily responsible for all material/moral damages that may arise in case of endangering the life and property safety/integrity of third parties, otherwise the BUYER accepts that the SELLER will not perform the said service and therefore the BUYER has no right of return.

5.6. The BUYER accepts that the cost of extra food and beverage, personal expenses, and all goods and services out of the defined service to be purchased outside the scope of the accommodation service will be paid by herself.

5.7. For the performance of the service subject to the contract, the electronically approved copy of this contract must be delivered to the SELLER and the price must be paid by the preferred payment method. If for any reason, the product price is not paid or canceled in the bank records, the SELLER is deemed to be relieved of the obligation to perform the service.

5.8. If the relevant bank or financial institution fails to pay the service fee to the SELLER due to the unfair or unlawful use of the BUYER's credit card after the performance of the service by unauthorized persons, not due to the BUYER's fault, the BUYER shall be responsible for the disputed service fee and any damages, together with the legal interest to be accrued from the date of booking. 

5.9. If the SELLER refuses to provide the service unfairly, the SELLER returns all payments made by the BUYER to the BUYER within 14 days.

5.10. The provisions of this contract concluded between the SELLER and the BUYER during the registration have been read by the BUYER and approved by requesting and accepting the registration on behalf of the other persons who receive the same service with him/her under the same conditions.

5.11. In matters not written in this Agreement; Law No. 1618, Law No. 6502 about the Protection of Consumers, Turkish Law of Obligations No. 6098, Turkish Commercial Law Code No. 6102, IATA, IHA, UFTAA Convention provisions, Civil Aviation Law, international agreements including Turkey, and  Bylaws, Regulations, Circulars and Communiqués issued in accordance with these and the provisions of the TÜRSAB Kütahya Schedule applied in Turkey of the internationally accepted Frankfurter Tabelle, shall be applied.

If the CONSUMER has problems with the SELLER, in case the SELLER cannot solve the problem;

-It is obligatory to apply to the district consumer arbitration committees in disputes with a value below 10.280 (ten thousand two hundred and eighty) Turkish Liras;

-In the provinces with metropolitan status, it is obligatory to apply to the Provincial Consumer Arbitration Committees in disputes between 10.280 (ten thousand twelve hundred and eighty) Turkish Liras and 15.430 (fifteen thousand four hundred and thirty) Turkish Liras;

-It is obligatory to apply to Provincial Consumer Arbitration Committees in disputes under 15,430 (fifteen thousand four hundred and thirty) Turkish Liras in the centers of provinces that are not in metropolitan status;

-It is obligatory to apply to the Provincial Consumer Arbitration Committees in disputes between 10.280 (ten thousand twelve hundred and eighty) Turkish Liras and 15.430 (fifteen thousand four hundred and thirty) Turkish Liras in districts of provinces that are not metropolitan.

No application can be made to consumer arbitration committees for disputes above these values. Applications can be made to the consumer arbitration committee and to the Consumer Courts in the place where the consumer is located or where the consumer transaction is made.

5.12. The facility may ask the BUYER for additional services of the hotel, mini bar, or credit card information for possible damages as of the date of the reservation.

5.13. As of the time the SELLER receives the invoice request for the BUYER's service, within 7-14 working days from the date of departure of the reservation, the BUYER sends the invoice, issued for the service, via the above-mentioned e-mail address.

5.14. Due to the "Accommodation Tax" added with Article 9 of the Law on the Amendment of Digital Service Tax No. 7194 and Some Laws and Decree-Law No. 375, the overnight service provided in accommodation facilities such as hotels, motels, holiday villages, hostels, aparthotel, guesthouse, camping, chalet, plateau house; and all other services offered within the accommodation facility by being sold together with this service (such as eating, drinking, activity, entertainment services and the use of the pool, sports, thermal and similar areas) are subject to accommodation tax.

The taxpayer of the accommodation tax is those who provide the services specified in the first paragraph, and the taxable event is the accommodation services provided by the relevant facility. The accommodation tax rate is 8%. In case of a change in the current accommodation tax rate and/or collection basis determined by the law, and in case of publication of regulation or communiqué, an update will be made according to the new application.

The consumer has been informed by this Agreement that he/she will pay accommodation tax at the entrance to the facility in accordance with the legal legislation.

5.15. This contract becomes valid after it is approved by the BUYER electronically. 

Since the contact information such as an address, telephone, and e-mail shared by the BUYER at the purchase process will be used for notifications, the responsibility of not notifying the changes in the contact information belongs to the BUYER.

5.16. Preliminary information and data entry errors in the distance contract can be corrected by notifying the e-mail address of abant@taksimotelcilik.com.tr.

5.17 The facility prices specified at the time of booking can only be applied to Turkish citizens. If one of the guests is a citizen of a different country other than the Turkish Republic, the property may request a price difference.

ARTICLE 6 – CANCELLATION, WITHDRAWAL, CHANGES:

6.1. The BUYER does not have the right of withdrawal in accordance with paragraph g of Article 15 of the Regulation on Distance Contracts, but the SELLER grants the BUYER the following rights to cancel, withdraw and make changes in order to ensure customer satisfaction:

A deduction is made in the amount specified in the reservation terms and conditions for cancellations or changes to be made after the reservation or for penalty applications. 

No refunds will be made for any cancellations or changes 3 days before the check-in day and after the check-in day.

6.2. The SELLER may partially or completely cancel the contract in cases of force majeure or service providers, hotels or third parties that prevent the continuation of the services announced or registered despite all due diligence. This situation must be notified to the BUYER as soon as possible. If the BUYER informs in writing that he/she does not accept these changes and cancellations, he/she has the right to cancel the reservation and receive a refund for all the services he/she has not used within 10 days from the written notification.

6.3. The facility may apply different prices for its customers aged 0 - 12. The BUYER accepts that the facility can check the identity card/passport on the day of arrival. The SELLER has the right to request the price difference from the BUYER if the age difference is detected in the information given at the time of booking for the child guests. If the price difference is not paid by the BUYER, the SELLER has the right to cancel the contract.

6.4. The BUYER has to share with the facility the information that he/she will not be able to check in to the hotel on the day of check-in or will check in late. Otherwise, the SELLER has the right to cancel the BUYER's reservation. In this case, the SELLER may request the amount specified in the reservation terms and conditions from the BUYER.

6.5. In case the BUYER leaves the facility before the end of the service performance date (before the end date of reservation), no refund will be made for the days he/she would not stay.

6.6. Without prejudice to the article 6.1. of the contract, if the SELLER grants the right to make changes at its own initiative, date changes, requests about taking the customer out are in the form of cancellation, and the form and conditions regarding cancellation are applied. The new reservation is made according to the campaign and payment conditions on the day of the change.

6.7. Without prejudice to the article 6.1. of the contract, if the SELLER grants the right to change at its own initiative, for Room Type Changes and Customer Addition requests, the campaign and payment conditions of the reservation are updated according to the conditions of the day the change is made, 

6.8. Without prejudice to the article 6.1. of the contract, if the SELLER grants the right to change at its own initiative, in the case of a person's name change in reservations with two or more people, the campaign and payment conditions of the reservation are updated according to the conditions of the day the change is made. A name change in single accommodation is void. However, the SELLER may, at its own initiative, update the campaign and payment conditions of the reservation according to the conditions of the day the change is made, without canceling the reservation.

6.9. Typographic errors (letter and spelling errors) made in names and surnames during reservation are corrected without any deductions or penalties.
